Factory construction utilizes advanced machinery, automated cutting, and strict quality-control protocols. Furthermore, materials are stored in dry indoor environments, eliminating the risk of warped framing lumber or mold growth caused by rain during construction. Because modular units must survive highway transit and crane hoisting, they are engineered with extra structural reinforcement, often using significantly more adhesive and fasteners than traditional homes.

Modular sections are delivered on large flatbed trailers and lifted onto foundations using industrial cranes. If a site is inaccessible for a crane or oversized load, modular construction may not be viable.
Upfront Cash Flow and Financing Challenges
Traditional site-built homes rely on staged construction draws paid out over 6 to 12 months. Modular manufacturers, however, often require significant deposits upfront and full payment for the module before it leaves the factory floor. Homeowners must secure specialized construction-to-permanent loans with lenders familiar with factory-built financing schedules.
Site Preparation and Local Builder Variance
While the factory builds the home modules, local contractors handle the site excavation, foundation, utility connections, roof capping, and interior finish work. If the local general contractor lacks experience with modular set-ups, seam finishing, or site plumbing tie-ins, quality issues and unexpected cost overruns can quickly arise.
Zoning and HOA Misconceptions
Although modular homes are legally classified the same as site-built homes, local zoning boards or homeowners associations sometimes confuse modular housing with HUD-code mobile homes. Navigating local permitting and clear architectural plan reviews early in the process is essential to avoid local municipal delays.
Specific Modular Home Laws in New York and Florida
Building regulations for modular housing vary significantly by jurisdiction. New York and Florida both enforce strict codes, but their regulatory focuses differ due to climate and energy requirements.
New York Modular Regulations:
19 NYCRR Part 1209 Compliance: In New York, modular homes are legally classified as “Factory Manufactured Buildings.” They are regulated under Title 19 NYCRR Part 1209 and must comply fully with the New York State Uniform Fire Prevention and Building Code and Energy Conservation Code.
Insignia of Approval: Every approved modular building unit shipped to or within New York State must bear an official Insignia of Approval issued by the New York Department of State (DOS), verifying third-party factory inspection prior to delivery.
All-Electric Building Mandate: Under New York’s Building Decarbonization requirements, new residential construction—including state-code modular homes under three stories—must adhere to all-electric building requirements, prohibiting fossil-fuel heating and equipment in new residential permits.
Florida Modular Regulations:
Florida Building Code (FBC) and DBPR Oversight: Modular homes in Florida fall under the Florida Manufactured Buildings Act (Florida Statute Chapter 553, Part IV) and are overseen by the Department of Business and Professional Regulation (DBPR). Unlike mobile homes, which follow federal HUD standards, modular homes must fully comply with the Florida Building Code.
Wind Load and High Velocity Hurricane Zones (HVHZ): Florida modular homes must meet stringent wind resistance standards. Units destined for coastal areas, particularly Miami-Dade and Broward counties (HVHZ), must be engineered to withstand extreme wind speeds exceeding 150 to 180 mph, complete with Florida Product Approvals for impact-resistant windows and doors.
Flood Elevation and Installation Laws: Per Florida Statute Chapter 489, modular home installation must be completed by a licensed Florida general or residential contractor rather than a basic mobile home set crew. Under FBC Residential standards, foundations in Special Flood Hazard Areas must meet strict FEMA base flood elevation guidelines.
